1. Who We Are and What We Do

CommercialLink.ca is a business financing brokerage operating in Canada. We act as an intermediary between business owners seeking financing and our network of A and B lenders — including chartered banks, credit unions, and alternative lenders.

We are not a lender. We do not make lending decisions, set interest rates, or guarantee financing approval. All financing decisions are made exclusively by the lender to whom your application is submitted.

CommercialLink.ca operates in British Columbia, Canada and serves clients Canada-wide.

2. Use of This Website

By accessing commerciallink.ca, you agree to use the website for lawful purposes only. You may not:

• Submit false, misleading, or fraudulent information through any form or communication
• Attempt to gain unauthorised access to any part of this website or its systems
• Use automated tools, bots, or scrapers to access or collect content from this website
• Reproduce, distribute, or republish any content from this website without our written permission
• Use this website in any way that could damage our reputation or interfere with other users' use of the site

We reserve the right to restrict or terminate access to any user who violates these terms.

3. Our Services — What We Provide and What We Do Not

• Free initial consultation to assess your business financing needs
• Identification of suitable lenders from our A and B lender network
• Assistance preparing and submitting your financing application
• Communication with lenders during the review and approval process
• Presentation of lender offers and explanation of terms

What we do not provide

• Legal advice — consult a qualified lawyer for legal matters
• Accounting or tax advice — consult a qualified CPA or accountant
• Investment advice — consult a registered investment advisor
• Guarantees of financing approval, specific interest rates, or specific loan amounts
• Credit repair services

4. Fees and Compensation

CommercialLink.ca earns compensation in two ways, both fully disclosed to clients before any agreement is signed:

• Borrower-paid brokerage fee — a percentage of the funded loan amount, as detailed in our Broker Fee Agreement signed before we begin work on your file. No fee is owed unless financing is successfully funded.
• Lender-paid commission — some lenders pay a finder's fee or commission to CommercialLink.ca directly upon funding. This is disclosed in our Fee Agreement.

Full fee details are set out in our Fee Disclosure. We do not charge upfront fees for initial consultations or application submissions.

5. Your Responsibilities

By engaging our services, you agree to:

• Provide complete, accurate, and truthful information at all times
• Promptly supply all documents requested during the financing process
• Notify us immediately if any information you have provided changes
• Not submit applications to lenders introduced by CommercialLink.ca without our knowledge during the term of our fee agreement
• Pay our brokerage fee as agreed upon successful funding of your financing

You acknowledge that providing false or misleading information may result in termination of our services and potential legal liability.

6. No Guarantee of Results

CommercialLink.ca makes no guarantee, representation, or warranty that:

• Your financing application will be approved by any lender
• You will receive any specific loan amount, interest rate, or term
• The financing product recommended is the only or best option available to you
• Lender decisions will be made within any specific timeframe

We act as your agent in submitting your application to lenders. Lenders are independent third parties and their decisions are outside our control.

7. Limitation of Liability

To the maximum extent permitted by applicable law, CommercialLink.ca, its principals, and representatives shall not be liable for:

• Any indirect, incidental, or consequential damages arising from your use of this website or our services
• Financing decisions made by lenders, including declines, unfavourable terms, or changes to offers
• Any errors or omissions in information provided on this website
• Any loss resulting from your reliance on preliminary financing estimates provided during consultation

Our total liability to any client for any claim arising from our services shall not exceed the brokerage fee actually paid by that client to CommercialLink.ca.

8. Intellectual Property

All content on commerciallink.ca — including text, design, logo, graphics, and layout — is the property of CommercialLink.ca and is protected by Canadian copyright law. You may not reproduce, copy, or distribute any content without our written permission.

The CommercialLink name and logo are proprietary and may not be used without written authorisation.

9. Third-Party Links and Services

Our website may contain links to third-party websites (lender websites, government resources, etc.). These links are provided for your convenience only. CommercialLink.ca does not endorse, control, or accept responsibility for any third-party website or its content.

10. Governing Law and Disputes

These Terms of Service are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute arising from these terms or our services shall be resolved in the courts of British Columbia, or through BC Small Claims Court for disputes under $35,000.

We encourage clients to contact us directly to resolve any concern before initiating legal proceedings.

11. Changes to These Terms

We may update these Terms of Service at any time. Material changes will be reflected in an updated "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
